I. PRELIMINARY PROVISIONS:
- Azzuro Rent d.o.o. as lessor (hereinafter: Lessor) rents out to legal persons and/or natural persons as lessees (hereinafter: User) the electric bicycles which it has on offer, and the User agrees to pay the Lessor the amount of the daily rent in accordance with the price list and the offer highlighted by the Lessor.
- By signing the Electric Bicycle Rental Contract (hereinafter: the Contract), the User confirms that it has read the General Terms and Conditions of Business (hereinafter: the General Terms and Conditions), which are attached to and form an integral part of the Contract.The terms defined in the Contract, unless otherwise specified, shall have the same meaning in these General Terms of Conditions of Business.
II. AUTHORISATION AND MANAGEMENT OF A RENTAL ELECTRIC BICYCLE:
- The Lessor will rent a maximum of two electric bicycle to an individual User, a natural person. The above limit of a maximum of two electric bicycle does not apply to the User as a legal entity or to organised, larger groups. In addition to the electric bicycle, the Lessor provides each User with a protective helmet in the rental price.
- In addition to the rental of the electric bicycle, the Lessor may also offer the User additional services for an additional fee, which may include the rental of additional equipment together with the electric bicycle, i.e. additional insurance for the User or additional accessories, etc. The electric bicycle can also be rented for organised guided tours, in which case payment is made in accordance with the Lessor’s price list.
- Rental of the electric bicycle is provided to the User with the restriction that the User must be at least 18 years of age, except if the User is between 16 and 18 years of age, in which case the User must be accompanied by at least one adult (parental person) and must operate the electric bicycle at their own risk.
- By signing the Electric Bicycle Rental Contract, the User confirms to know how to operate the electric bicycle and known about the traffic regulations, and accepts full personal and individual responsibility for themselves, as well as for their minor child over the age of 16, and for any damage that could result to them from injury or damage to their health as a result of falling or riding the electric bicycle and using the electric bicycle, and relinquishes all claims for damages against the Lessor. All compensation claims for personal injury resulting in permanent disability or death of the User may be made by eligible persons against the insurance company with which the Lessor has a third party insurance policy.
- The User is obliged to report any damage (if any part of the equipment mentioned is missing or if there are other defects in the electric bicycle) to the Lessor immediately after it has occurred, i.e. when returning the electric bicycle, as otherwise the User takes the risk of the insurer’s liability to repair the damage being cancelled due to the failure to report the damage on time.The dedicated electric bicycles offered for rental are in good technical condition and Users agree to use them at their own risk.
- The technical specifications of individual electric bicycles may be changed depending on the availability of spare parts. It is not the responsibility of the Lessor to provide instructions on the use of the electric bicycle, and Users confirm that they are competent and familiar with the use of the electric bicycle.
- The User agrees to use the electric bicycle only for personal purposes and not to use it under the influence of alcohol, drugs or other substances which may affect the safe use of the electric bicycle, for illegal purposes, for sporting events and not to make it available to third parties.
- The User agrees to use the electric bicycle with the attention of a good host, use the electric bicycle only for recreational cycling on marked cycle paths, not to expose the electric bicycle to jumps and inappropriate cycling off paths and roads, to protect the electric bicycle from possible damage, breakdowns and alienation, not to expose the electric bicycle to management which is not appropriate for the use of the electric bicycle and equipment. The rented electric bicycle may only be used personally by the User, i.e. the authorised person specified in the Electric Bicycle Rental Contract, in accordance with the provisions of these General Terms and Conditions and all applicable legal regulations.
- The User is obliged to wear a protective helmet when using the electric bicycle. The Lessor is released from any liability for damage in the event that the User does not wear a protective helmet when operating the electric bicycle.
- The Lessor recommends that each User always be in possession of personal travel insurance during rental of the electric bicycle.
- The User is obliged to use the rented electric bicycle only within the borders of the Republic of Croatia.
III. PICK UP AND DELIVERY OF THE ELECTRIC BICYCLE:
- The User is obliged to check the condition of the electric bicycle and other accessories when picking up the electric bicycle. Upon pickup, the User confirms that the User has checked the condition of the electric bicycle, that the User has taken over an electric bicycle that is mechanically operational and that the User has no other objections to the condition and quality of the electric bicycle.
- The User is obliged to pick up the electric bicycle at the agreed time, whereby in the event of a delay in picking up the electric bicycle, the User is obliged to inform the Lessor in advance. If the electric bicycle is not picked up by the end of the rental date, the user is not entitled to a refund of the rental amount paid.
- Pickup of the electric bicycle takes place at the rental office of the Lessor, or by pre-arrangement it may also be delivered to the user in an area no more than 15 km from the Lessor’s rental office. A change of the electric bicycle pickup of location with less than 24 hours before the rental start date will incur a fee of €30 per electric bicycle. The costs for delivery of the electric bicycle beyond 15 kilometres from the Lessor’s rental office can be agreed individually with the User.
- The User ordering the delivery of the electric bicycle to an address other than the rental office of the Lessor is obliged to provide all necessary data enabling the delivery of the ordered electric bicycle.
- Users are responsible for ensuring that the the property administrator (at the accommodation) agrees to accept delivery of the electric bicycles and to ensure that the bicycles are securely stored until they are handed over to the User. Similarly, Users are responsible for ensuring that the property administrator at the appointed collection address agrees to store the electric bikes securely and turn them over to our company for return.
- The Lessor’s main rental location for electric bicycles is at Marina Polesana Pula at the address Vallelunga 90.
IV. RENTAL DURATION AND RETURN OF THE ELECTRIC BICYCLE:
- Each electric bicycle is rented for the shortest period of one calendar day via the booking channels provided by the Lessor.
- The daily rental period means the rental time valid until the end of the Lessor’s working hours at the latest, starting from the same day on which the rental started. Working hours depend on the type of season and are always updated on the electric bike rental website under www.azzurobikes.com.
- According to the standards adopted by the rental company, collection of ordered e-bikes takes place between 08:00 -12:00 and returns of e-bikes take place between 16:00 and 18:00.
- The User is obliged to return the electric bicycle at the latest by the end of the operating hours of the Lessor’s rentaal office. Unless otherwise agreed in writing by the parties.
- The User undertakes to pay the agreed rental price for the electric bicycle in advance, immediately upon signing the Contract. If the User has requested, and the Lessor has agreed, to an extension of the rental, the User shall be obliged to pay the agreed price for the extension of the rental immediately at the time of the extension.
- The Lessor is not obliged to refund the rental amount paid in the event of early return of the electric bicycle due to a change in weather conditions, complete discharge of the battery of the electric bicycle or other circumstances on the part of the User.
- Daily rental prices for individual electric bicycles are published on the website of the electric bicycle rental company managed by the Lessor.
- When returning the electric bicycle, the Lessor will inspect the electric bicycle in the presence of the User and point out to the User any possible damages, malfunctions and defects.
- The User is responsible for any damage or loss of personal property, accidents/injuries to others related to the rental equipment.
- The return of the electric bicycle takes place at the Lessor’s rental office or, by pre-arrangement, can be collected and returned to the Lessor at a location no more than 15 km away from the Lessor’s rental office. A change of the return location of the electric bicycle less than 24 hours prior to the rental end date incurs a charge of EUR 30 per electric bicycle. The costs for return of the electric bicycle beyond 15 kilometres from the Lessor’s rental office can be agreed individually with the User.
- At the end of the agreed rental period, the User is deemed to have knowingly and unauthorisedly alienated the electric bicycle, in which case the Lessor may immediately make a report and inform the relevant police station.
V. ELECTRIC BICYCLE MAINTENANCE:
- The User agrees to use, maintain, store and charge the electric bicycle with care and not to make any changes or modifications to the electric bicycle.
- The User is obliged to immediately stop cycling in the event of a malfunction of the electric bicycle and to immediately inform the Lessor. For this purpose, each electric bicycle is equipped with a visual sign (information sticker), which is placed on the frame of the electric bicycle with the emergency telephone number of the rental company. Other contact details are published on the website of the rental company managed by the Lessor.
- The Lessor is responsible for structural defects such as damaged frames, worn bottom brackets, suspension and wheel hubs. The Lessor is not responsible for the following incidents during the rental of the electric bicycle: gear tune ups / punctures / broken spokes / broken chains / broken derailleurs / broken drop-outs / wheel rim damage / torn saddles / stripped threads on pedal crank / damage beyond the Lessor’s control and resulting from use or misuse by the User.
- The User will keep control of the electric bicycle in their possession at all times during the rental period and will not abandon or leave it unattended.
VI. INSURANCE:
- The User undertakes to cover all damages, up to the full value of the electric bicycle, arising during the rental period, as well as damages for loss of profit in connection with the repair of the electric bicycle, up to a maximum of 30 days, if these arise through the fault of the User.
- Damages for lost profits are determined for each starting day, when the electric bicycle could not be used regularly, in the amount of one daily rental according to the Lessor’s price list for that particular model of electric bicycle.
- The User is obliged to cover any damage (damage, loss, theft of the electric bicycle or its parts, loss of profit), if the damage is caused by the use of the electric bicycle not in accordance with the provisions of the Contract and the General Terms and Conditions.
- In the event of the theft of the electric bicycle, the User is deemed to have grossly violated the provisions of the Contract and then is liable to the Lessor for the full amount of the resulting damage and cannot be released from the obligation to compensate for the damage.
- In the event of a traffic accident, the User undertakes to call the police at the scene of the accident immediately or to report the incident to the relevant police station.
- The Lessor reserves the right to require a deposit from the User in advance for the individual electric bicycle as a security measure to assert any future claims on any basis.
- The provision of a guarantee in the form of a collected deposit does not exclude the possibility of claiming an additional amount from the User in the event of a serious breakdown, damage or theft of the electric bicycle.
- Replacement values in the event of loss, stolen or damaged rental items are included in Appendix 1 below. The values quoted include taxes already applicable in Croatia.
VII. COLLECTION AND PROCESSING OF PERSONAL DATA:
- The User submits personal data voluntarily, and by entering them via the channel provided by the Lessor dedicated to the booking of electric bikes and additional services, the User is deemed to have agreed to their use for the purpose of signing a Contract with the Lessor.
- The Lessor undertakes to protect the personal data processed from the User in an adequate measure and to keep it confidential in accordance with the relevant data protection regulations and only within the scope of the legal authorisation and the purpose for which it was collected. The User’s personal data is collected for the purpose of concluding the Contract with the Lessor, in accordance with the applicable legal regulations on the protection of personal data.
- The User’s rights and the protection by law with regard to personal data are set out under the relevant legislation, in particular the Act on the Implementation of the General Data Protection Regulation (Zakon o provedbi Opće uredbe o zaštiti podataka).
- To ensure the security of the collection and processing of the User’s personal data, the Lessor provides a dedicated online electric bicycle booking system via a website or application, with the responsibility of the User to enter true and correct personal data into the booking system, under the pain of material and criminal liability. A document specifically including the rights of those affected by the Lessor’s processing of personal data has been published on the rental company’s website under Privacy Policy.
VIII. FINAL PROVISIONS:
- By signing the Contract, the User unconditionally accepts all of the above terms and conditions, guarantees the accuracy of all information provided to the Lessor and, in the event of any dispute, accepts the actual and local jurisdiction of the court corresponding to the registered seat of the Lessor, with the application of Croatian law in the event of a legal dispute.
- In the event of any litigation, only the English version of these General Terms and Conditions will apply, which in that case shall be deemed to be the original.
